Terms of Service
Effective date: January 1, 2026
Welcome to Brightment, an AI-powered platform that helps homeowners visualize basement egress windows and, where selected, arranges the design, permitting, and installation of those windows. These Terms of Service (“Terms”) govern your use of the Brightment app, website, and related services, and constitute a binding agreement between you and Brightment, a property of Uritect Inc., based in Ontario, Canada. By accessing or using our services, you agree to these Terms.
1. Acceptance of terms
By using Brightment, you agree to comply with these Terms. If you do not agree, you must discontinue use of our services immediately. We may revise these Terms at any time; continued use of the platform after a revision indicates your acceptance of the updated Terms.
2. User accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. We reserve the right to suspend or terminate accounts without notice for activity that violates these Terms or applicable law.
3. Free credits and fair use
New accounts receive a limited number of free design generations. Excessive or automated use that negatively impacts platform performance for other users is prohibited, and we may suspend accounts that breach fair use. Where purchases are enabled in the future, they will be governed by additional terms presented at the time of purchase.
4. Intellectual property and license
All content provided by Brightment — including AI-generated design concepts, the app, and the website — is the intellectual property of Brightment / Uritect Inc. You are granted a non-exclusive, revocable license to use generated concepts for your own personal, non-commercial purposes (such as evaluating a potential project). You may not reproduce, resell, or redistribute concepts without our prior written consent.
Photographs you upload remain your property, but by uploading them you grant Brightment a license to use, process, and store them for the purpose of generating your design concepts, running your project (if you proceed with installation), and improving our services.
5. AI output and limitations
Brightment uses AI to generate realistic design concepts of egress windows, window wells, and landscaping. These concepts are visualizations for inspiration and decision-making only — they are not engineering drawings, structural assessments, or a guarantee of the final installed result. Actual egress requirements, dimensions, and finishes are confirmed only through an in-person site assessment prior to any work beginning. Brightment disclaims liability for decisions made solely on the basis of an AI-generated concept.
6. Installation services
Where you engage Brightment for design, permitting, excavation, or installation work, that work is governed by a separate signed quote or contract, which will set out pricing, scope, timeline, and warranty terms specific to your project. These Terms govern your use of the app and website; the signed project agreement governs the installation itself.
7. Limitation of liability
To the fullest extent permitted by law, Brightment, Uritect Inc., and their officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app or website, including loss of profits, data, or goodwill, whether based in contract, tort, or otherwise. Where liability is found, our total liability relating to your use of the app or website will be limited to the amount, if any, you paid us for that use in the 12 months preceding the claim. This section does not limit liability arising from a separately signed installation contract, which is governed by its own terms.
8. Indemnification
You agree to indemnify and hold Brightment and Uritect Inc. harmless from claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the app or website, your violation of these Terms, or your infringement of any third-party rights.
9. Governing law and dispute resolution
These Terms are governed by the laws of Ontario, Canada. Disputes arising from these Terms or your use of the app or website will be resolved through binding arbitration in Ontario. Claims must be brought within one (1) year of the event giving rise to the claim.
10. Data protection and privacy
Your personal information, including photos and generated designs, is collected and processed in accordance with our Privacy Policy, which complies with the Personal Information Protection and Electronic Documents Act (PIPEDA). By using Brightment, you consent to the collection, use, and sharing of your information as outlined there.
11. Termination
We may suspend or terminate your access to the app or website at our discretion, without notice, if you violate these Terms or applicable law. Provisions that by their nature should survive termination — including intellectual property and indemnity clauses — remain in effect.
12. Severability & force majeure
If any provision of these Terms is found unlawful or unenforceable, that provision is severable and will not affect the remaining provisions. Brightment is not liable for delay or failure to perform caused by events beyond its reasonable control, including severe weather, labour disruptions, or government regulations affecting permitting or supply.
